Krystal Hotels & Resorts’s Privacy Policy in Mexico

Please read these terms and conditions carefully before using this site.

This website (hereinafter the "Site") provides you with information about hotels and other temporary accommodation facilities (each, a "Hotel") that are owned, managed, or operated under the franchise of Hotelera SF, S. de R.L. de C.V. or its affiliates and subsidiaries (hereinafter collectively "Hoteles Krystal"). The use of this Site is subject to the unconditional acceptance by the user ("User(s)") or by you ("You(r)") of the following terms and conditions (all of them collectively referred to as the "Conditions"):

The services of this Site are available only to those individuals who can enter into legally binding contracts under applicable law, and therefore are not available to minors. By accessing this Site, You represent that You are of legal age to use this Site and to assume legally binding obligations with respect to any liability You may incur as a result of the use of this Site.

You may only use this Site to make legitimate reservations or purchases and may not use it for any other purpose.

This Site must be used exclusively by You for personal use. The use of this Site for commercial purposes is expressly prohibited, unless You have the prior written consent of Hoteles Krystal. You agree that You will not interfere or attempt to interfere in any way with the proper functioning of the Site. You agree not to transmit to Hoteles Krystal and/or this Site: (i) any type of virus and/or other computer programming routines intended to damage, adversely interfere with, intercept or expropriate any system, data or information; nor (ii) any content that may create liability for Hoteles Krystal or that may cause Hoteles Krystal to lose (in whole or in part) the services of our suppliers.

This Site contains and references trademarks, patents, products, processes or other proprietary rights of Hoteles Krystal or third parties. You are not granted or conferred any license or right to such trademarks, patents, products, processes and other proprietary rights of Hoteles Krystal or third parties. No material from this Site may be reproduced, distributed, published, displayed, recorded, or transmitted or assigned.

The trademarks, logos, and service marks along with the trade name displayed on this Site (collectively, the "Trademarks") are registered trademarks in accordance with the applicable laws of the United Mexican States ("Mexico"). Any reproduction or use of the content of this Site without the express written consent of Hoteles Krystal is prohibited. Nothing contained on this Site shall be construed as a possible grant, implied right, estoppel or otherwise, of any license or right to use any of the Trademarks without the written authorization of Hoteles Krystal or any third party that may own the Trademarks.

This Site, including each of its modules, is protected by the copyright of Hoteles Krystal and/or its various suppliers and distributors. This Site and its content may not be copied, reproduced, republished, recorded, posted, modified, transmitted or distributed without the written authorization of Hoteles Krystal, but You may download, view and print one copy of the materials presented on this Site for personal, non-commercial use only. Unauthorized use of this Site and/or the materials contained herein may violate applicable copyright and trademark laws, as well as property laws or other laws. You must retain all copyright and trademark notices, including any proprietary information notices, contained in these materials.

By submitting any ideas, comments, complaints, suggestions, CVs or other information to Hoteles Krystal regarding improvements to the Site or services related to the Site ("Feedback Information"), You agree that such Feedback Information shall be considered the property of Hoteles Krystal and shall remain its property. None of the Feedback Information on the Site shall be subject to any obligation of confidentiality by Hoteles Krystal, and Hoteles Krystal shall not be liable for any use or disclosure of the Feedback Information. Hoteles Krystal shall own all rights associated with the Feedback Information (including, without limitation, intellectual property rights and moral rights) and shall be entitled to use it without restriction for any purpose, commercial or otherwise, without any compensation to You.

When You reserve or purchase travel services through this Site, the information You provide about Yourself will be provided to any other third party involved in arranging Your trip. When You browse, reserve or purchase travel services through this Site, such information may be provided to the relevant suppliers or other third parties involved in the organization of Your trip.

This Site contains links to other websites that may collect personal information about You. When You click on one of these links, You will enter another website for which this Site assumes no responsibility.

In addition to the circumstances described above, Hoteles Krystal may disclose information if required by law, a court order, or any other governmental or law enforcement authority, or if in good faith it believes that such disclosure is necessary or appropriate, including, without limitation, to protect the rights or property of Hoteles Krystal when there is reason to believe that disclosure of the information is necessary for the purposes of identifying, contacting or bringing legal action against someone who may be violating our rights or property, either intentionally or otherwise, or when any other person could be harmed by such activities.

In addition to the other terms and conditions specified on this Site in relation to our Hotels, the following general terms and conditions apply to Hotel reservations made through this Site: (a) Cancellation policies and other information about reservations for specific rooms and hotels may vary by Hotel and reservation type and (b) requests for special features such as bedding type or non-smoking rooms are simply requests and while most Hotels will strive to accommodate them, neither Hoteles Krystal nor the Hotel guarantee that they will comply with Your request.

Hoteles Krystal, in addition to any other rights or remedies available to it, may at its sole discretion at any time and without notice, terminate or restrict the User's access to this Site and any related services without incurring any liability to the User.

Additional terms and conditions may apply to reservations, purchases of products and services, and any other use made of parts of this Site, and You agree to abide by such additional terms and conditions.

Hoteles Krystal reserves the right to unilaterally modify any of the terms and conditions of these Conditions without prior notice, and Your continued use of this Site will be subject to the Conditions in effect at the time of Your use. Therefore, You agree to review these Conditions periodically, and Your continued access, use, and/or advertising on this Site will be deemed Your acceptance of the modified Conditions.

You agree that Your use of the site is at Your own risk. The Site and any related information, content or materials are provided "as is" without any warranties of any kind.

The User shall be liable for any damages and/or losses of any nature that Hoteles Krystal may suffer as a result of the breach of the law or any of the general conditions established in these Conditions.

In no event shall Hoteles Krystal, its agents, representatives or licensors be liable to You or any other third party for any losses, injuries or damages of any kind, direct, indirect, punitive, special, incidental, consequential or otherwise (including, without limitation, lost profits or loss of savings) arising out of or in any way connected with: (1) Your use of this Site; (b) any failure or delay (including but not limited to the use of or inability to use any component of this site for reservations or ticket purchases); or (c) the performance or non-performance by Hoteles Krystal or a provider of products or services related to this Site, even if such party has been advised of the possibility of such damages to such third parties. You hereby waive any and all claims against Hoteles Krystal, its agents, representatives and licensors arising out of or in any way connected with Your use of the Site and/or any other related product or service. If Hoteles Krystal is found liable for damages in connection with this Site, Your sole and exclusive remedy shall be limited to the reimbursement of the charges for the services or products You paid for but were not provided.  

Any dispute arising out of or relating to the Site shall be governed by, construed and enforced in accordance with the laws of Mexico and shall be submitted to the exclusive jurisdiction of the courts of Mexico City, Federal District.
